The petitioner seeks regular bail in connection with Benipatti P.S. Case No. 253 of 2017 corresponding to G.R. No.999 of 2017, for the offences punishable under Sections 341, 324, 307 and 120(B) of the Indian Penal Code and section 27 of the Arms Act.

The allegation is regarding the accused persons having shot the son of the informant on account of certain land dispute.

The learned senior counsel for the petitioner submits that there is general and omnibus allegation and if the case diary is perused especially the statement of the victim he has not named the petitioner as a person who could have shot the victim. It is

Patna High Court Cr.Misc. No.20252 of 2018 (3) dt.17-05-2018 2/2 further submitted that the petitioner is in custody since 21.11.2017 and has a clean antecedent. It is also submitted that similarly situated accused person has already been granted bail vide order dated 18.04.2018 passed in Criminal Miscellaneous No. 12259 of 2018.

Learned counsel appearing for the informant and the learned counsel for the State have vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, District- Madhubani in connection with Benipatti P.S. Case No. 253 of 2017, corresponding to G.R. No.999 of 2017.
