The petitioner seeks regular bail in connection with Awtarnagar P.S. Case No. 83 of 2017, registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
The allegation is regarding the petitioner, who happens to be the husband of the victim lady, having killed the victim lady on account of non fulfillment of the demand for dowry. The learned counsel for the petitioner, referring to the case diary, has submitted that various witnesses in Paragraph Nos. 47, 48, 67 and 68 have supported the fact that the victim lady was admitted in a hospital at Chapra and on account of illness, she died. Patna High Court Cr.Misc. No.23773 of 2018(4) dt.03-07-2018 2/2 antecedent and he is languishing in custody since 12.03.2018. Having regard to the facts and circumstances of the case as also the materials available in the case diary, I am of the view that the petitioner deserves to be granted bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 11th, Saran at Chapra in connection with Awtarnagar P.S. Case No. 83 of 2017.
