Mr.Satyavrat Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sikandra P.S. Case No. 128 of 2019, registered under Sections 147, 149, 342 and 353 of the Indian Penal Code. The accusation is that on receiving information about death of Nandlal Thakur due to dashing by Bolero vehicle

No.64473 of 2019(2) dt.24-10-2019 2/3 at Maharath More near Pirhinda village, the informant along with other police personnel reached there then saw that dead body of one person was lying on the road and mob blocked the road and vehicles were also stopped. While informant and other officials requested to clear the road but seven persons named in the F.I.R. including the petitioners and 20 to 25 unknown, who were present there, did not ready to clear the road and the members of mob created nuisance in discharging of official duty.

Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act has been attributed against them except that these petitioners refused to remove the dead body for clearing the road. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned J.M. Ist Class, Jamui, in connection with Sikandra P.S. Case No. 128 of 2019,
