The petitioner seeks regular bail in connection with Udwantnagar P.S. Case No. 255 of 2017, registered for the offence punishable under Section 304(B) of the Indian Penal Code.

The allegation is regarding the petitioner, who is the husband of the victim lady and other accused persons having strangulated the victim lady to death on account of non fulfillment of the demand for dowry.

The learned counsel for the petitioner referring to the case diary has submitted that apart from suspicion, there is no evidence of the petitioner having strangulated the victim

Patna High Court Cr.Misc. No.22544 of 2018(4) dt.02-07-2018 2/2 lady inasmuch as there is no demand for dowry. It is further submitted that the petitioner is languishing in custody since 27.08.2017.

Per contra, the learned counsel for the informant has submitted that in such type of cases, there is no question of any eyewitness and moreover, it has been consistently found during the course of investigation that there was demand for dowry and the medical report also supports the case of the prosecution to the effect that the victim has been strangulated and it cannot be anyone, but the husband-petitioner who has done to death the victim lady.

Having regard to the facts and circumstances of the case, I do not find any merit in the present petition. Accordingly, the same is dismissed.

However, the court below is directed to expedite the trial.
