Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 420, 379,411/34 of the Indian Penal Code and 04/2022 MM(DR) Act, 11/43 BM (CPIMTS) Rule 2019 and 56 BM (CPIMTS) Rule 2021. Petitioners were members of the Whatsapp group involved in illegal mining of minerals and its transportation. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Petitioners name have figured during

Patna High Court CR. MISC. No.66454 of 2022(2) dt.04-04-2023 2/2 course of investigation in confessional statement of co-accused. No incriminating material has been recovered from their conscious possession. Petitioner no.1 is senior citizen, whereas petitioners no. 2 and 3 are students.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura in Shekhopur Sarai Police Station Case No. 155 of 2022, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
