Petitioner, already in custody, seeks bail in connection with Meerganj PS Case No.9 of 2017, giving rise to Special Case No.64 of 2017, registered under Sections 363 and 366(A) of the Indian Penal Code.

Allegation in brief is that 15 years minor daughter of the informant was enticed away by the petitioner. Learned counsel for the petitioner submits that it is a case of elopement and there was a consent, the girl moved to Delhi and returned back. However, as per the medical report, the age of the girl was 15 to 16 years and she also supports the allegation.

Having considered the aforesaid facts and

No.14650 of 2018(3) dt.07-05-2018 2/2 circumstances, in particular the age of the girl, the prayer of bail of the petitioner is rejected in connection with Meerganj PS Case No.9 of 2017, giving rise to Special Case No.64 of 2017, pending in the court of learned 1st Additional Sessions Judgecum-Special Judge, Purnea.
