JUSTICE ARUN KUMAR ORAL ORDER 16-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 25.7.2017, seeks bail in Sultanganj PS Case No. 224 of 2017 registered under Sections 366A of the IPC.
The allegation in brief is that the petitioner enticed away minor daughter of the informant.
Learned Counsel for the petitioner submits that the girl has stated in her statement that she was taken by the petitioner to his relative's place and only stated to have misbehaved with her. Learned Counsel further submits that it was a case of elopement, the Board has assessed her age as 16 - 17 years though she is major. Having considered the said facts and circumstances, the petitioner, namely, Ganga Mandal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst Bhagalpur in connection with Sultanganj PS Case No. 224 of 2017.
