2. The petitioner apprehends his arrest in connection with G.R. Case no.15 of 2022 registered under sections 18(a), 18 (c), 28, 28(a) and 27(b)(ii) of the Drug and Cosmetic Act, 1940.
3. The allegations in the F.I.R is that the petitioner continued to run his shop of Drug/medicine despite expiry of his license.
4. Learned counsel for the petitioner submits that F.I.R itself would reveal that petitioner was continuing to run his shop even after his license had expired. It is further submitted that license had expired on 22.02.2022 and the raid had been conducted on 22.10.2022 and in the meantime, the petitioner
Patna High Court CR. MISC. No.66096 of 2025(2) dt.19-09-2025 2/3 was trying his best to get his license renewed but on account of some illegal demands, the same would not be done. It is further submitted that there is no complain from any customer with regard to quality of medicine. The petitioner undertakes to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the aforesaid facts of the case and also considering that the allegations are confined to running the shop in absence of valid license and besides this, there is no allegation of any fake or spurious medicine being sold by the petitioner, there is no complain from the customers and also considering that license of the petitioner stands expired which was not being renewed, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with G.R. Case no.15 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the
Patna High Court CR. MISC. No.66096 of 2025(2) dt.19-09-2025 3/3 B.N.S.S, 2023 and subject to the following conditions:- (I) One of the bailors of the petitioner shall be the family member/close relative of the petitioner. (II) He shall co-operate in the investigation/trial and would make himself available before the Investigating Officer as and when required till investigation is concluded against him.
