JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner is seeking regular bail in Bhorey P.S. Case No. 240 of 2017 registered under Sections 341, 323, 324, 325, 354, 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner and the informant are own brothers and they were fighting over plucking of Parwal vegetable. The allegation is that when the informant and his wife had gone to pluck Parwal the petitioner tried to stop them and thereafter they came back. It is because of these reasons the alleged occurrence took place. Learned counsel submits that there is a case and counter-case and all the injuries suffered by the informant party are simple in nature. The petitioner has one case on his head which was lodged

Patna High Court Cr.Misc. No.63737 of 2017 (2) dt.11-01-2018 2/2 in the year 2007 and in that case he is on bail. Considering the facts and circumstances, let the petitioner, namely, Hari Bhagat, be released on bail on his furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XII, Gopalganj in connection with Bhorey P.S. Case No. 240 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
