The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 385, 386, 307, 379/34 of the Indian Penal Code and added Section 302 of the IPC and Section 27 of the Arms Act.
The allegation against the petitioner along with others is of firing gunshot to the informant due to non payment of ransom money. Thereafter they looted Rs. 10,000/- cash from the informant. It is further submitted that during course of treatment the informant died.

He has falsely been implicated in this case. He submitted that the only on the basis of suspicion the name of the petitioner has come into light. There is no consistent evidence and no eye-witness to show that the petitioner has involved in the alleged occurrence. He further submitted that the petitioner was not present at the place of occurrence and at that time he was at Banglore in Hyderabad, State of Telangana on his duty to supply drinking water door to door. From the perusal of the para-69 of the case diary it transpires that without any investigation of fact and evidence the petitioner has been arrested by police from Hyderabad. He has got no criminal antecedent as stated in para3 of the bail application. It is further submitted that the petitioner is languishing in judicial custody since 01.08.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail.
