Petitioner, already in custody, seeks bail in connection with Tarari P.S. Case No.06 of 2018 registered under Sections 341, 323, 448 and 302/34 of the Indian Penal Code. Allegation in brief is that over the issue of throwing cow dung and the dispute over the Rasta, it is alleged that all three accused persons assaulted the father of the informant, his mother as well as 15 years old cousin.

Learned counsel for the petitioner submits that on account of land dispute, petitioner has falsely been implicated in this case, there is general and omnibus allegation of assault by three persons, however, only one head injury was found which the cause of death but there is no evidence to show that who

Having considered the aforesaid facts and circumstances, petitioner Surendra Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Ara, Bhojpur in connection with Tarari P.S.
