2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 307 and 504 of the Indian Penal Code .
Patna High Court CR. MISC. No.68159 of 2024(2) dt.08-10-2024 2/3 3 . As per prosecution case , on the alleged date and time of occurrence , this petitioner along with other coaccused persons assaulted informant and other due to which they sustained injuries.
4. Learned counsel for the petitioner submits that specific accusation of assault is against other co-accused persons and so far as this petitioner is concerned, there is no allegation of specific overt act alleged against him. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the fact that there is no allegation of specific overt act alleged against this petitioner, clean antecedent of this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Jamui in connection with with Jhajha P.S. case No. 125 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal
