This is a case registered under Sections 304 (B), 201/34 of the Indian Penal Code in connection with Bishambharpur P.S. No. 114 of 2017 pending in the court of Additional Chief Judicial Magistrate X, Gopalganj.

It is submitted by the petitioner's counsel that the petitioner has falsely been implicated in this case. From the case diary it is apparent that the uncle of the deceased has participated in the cremation but he did not inform the police Counsel for the informant has submitted that there is nothing on record to suggest that they have taken any steps for making available medical attention to the petitioner, even though

Patna High Court Cr.Misc. No.24922 of 2018 (3) dt.24-05-2018 the submission is of death due to suicide by hanging. Petitioner being husband has primary responsibility for safety and security of the wife. It appears from the case diary that other witnesses have supported the allegation against the petitioner. Considering the nature of allegation, this Court, for the present, is not inclined to enlarge the petitioner on bail. The prayer for bail is therefore, rejected.
