JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2018 Prayer for bail of the petitioner was earlier rejected by this Court vide order dated 18.7.2017 passed in Cr.Misc.No. 27102 of 2017 with a direction to the trial court to expedite the trial and conclude it within four months.

From the report it appears that out of seven witnesses four have been examined and the trial is pending for examination of remaining three witnesses and learned Special P.P. ensured that remaining witnesses will be produced on each and every date. Heard learned APP also.

In such view of the matter, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within two and a half months by

Patna High Court Cr.Misc. No.62513 of 2017 (3) dt.24-01-2018 2/2 conducting on day to day basis. At the same time, Superintendent of Police, Sitamarhi is directed to ensure the presence of the witnesses in court, so that the trial may be concluded within the time specified. Needless to say that petitioner has to co-operate in disposal of trial.

It is made clear that if the trial is not concluded within the extended period, trial court shall release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
