The petitioner seeks bail in Islampur P.S. Case No. of registered under Sections 147/149/341/323/353/504/120(B) of the Indian Penal Code. Petitioner along with several other accused persons are said to have created commotion and raised anti administrative slogan and assaulted the police personnel by means of lathi over road accident claiming lives of a girl child and two women. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to dirty village politics. He happens to be member of the mob.
Patna High Court Cr.Misc. No.24770 of 2018 (3) dt.23-05-2018 2/2 Allegation levelled against the petitioner is not specific rather general and omnibus in nature. Though the petitioner is said to have assaulted the police personnel, but the injury sustained by the victim is simple in nature. Petitioner had not made any assault rather someone else from the mob assaulted the victim and it was not possible to pinpoint the assailant in such a huge crowd. The petitioner has been languishing in custody since 18.03.2018. Learned APP for the state opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 56 of 2018.
