This is an application for grant of anticipatory bail in connection with Gaurichak P.S. Case No. 226 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
The case of the prosecution is that the informant was assaulted by the son of the petitioner and other accused persons resulting in grievous injury to him.
The learned counsel for the petitioner submits that the petitioner herein is the mother of Doman Yadav and there is no allegation of any specific overt act as against the petitioner herein. It is further submitted that the petitioner has a clean antecedent
Patna High Court Cr.Misc. No.884 of 2018 (3) dt.15-01-2018 2/2 and she has been merely implicated in the present case on account of being the mother of the main accused person. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna City at Patna in connection with Gaurichak P.S. Case No. 226 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
