JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Bibhutipur P.S. Case No. 162 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.
Allegation as per FIR is of recovery of huge quantity of liquor from the Hen Farm of one Ram Binod Mahto and petitioners and others were seen fleeing away from the place of occurrence.
Submission of learned counsel for the petitioners is that they have falsely been implicated only because they were seen fleeing away and nothing has been recovered either from
Patna High Court CR. MISC. No.60140 of 2019(2) dt.23-09-2019 2/2 their possession or from their house and they have no criminal antecedent.
Heard learned APP also.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Samastipur, in connection with Bibhutipur P.S. Case No. 162 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
