The petitioners seek regular bail in connection with Maner PS case no. 507 of 2017 instituted for the offences punishable under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.
The allegation is regarding recovery of 100 ltrs. of illicit liquor from the land situated near Sone river and it is alleged that the petitioners had fled away from the said place after seeing the police and upon chase, the petitioners were apprehended by the police.
The learned counsel for the petitioners submits that no recovery has been effected from the conscious possession
Patna High Court Cr.Misc. No.63531 of 2017 (2) dt.17-01-2018 2/2 of the petitioners and they have been falsely implicated in the present case. It is further submitted that the petitioners have clean antecedents and they are in custody since 15.10.2017. Considering the nature of accusation, clean antecedent of the petitioners and the period of custody undergone, I deem it fit and appropriate to enlarge the petitioners on regular bail. Accordingly, the petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Maner PS case no. 507 of 2017.
