2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 37 of the Bihar Prohibition and Excise Act and Sections 126(2), 115(2), 191(1), 191(2), 191(3), 190, 109, 132, 121(1), 121(2), 352, 351(3) and 3(5) of B.N.S.
3. The case of the prosecution is that there was scuffle between two groups. When the police reached there, it is alleged that 12 named and other unknown miscreants started pelting stone on the police personnel due to which they received injuries. The only allegation is against co-accused Bablu who was found in the state of intoxication. There is no any specific allegation against this petitioner.
4. Learned counsel for the petitioner submits that the

Learned counsel for the petitioner has submitted that no any specific allegation has been levelled against the petitioner. He has been falsely implicated in this case. Similarly situated other co-accused persons have already been granted bail by learned co-ordinate Bench of this Court vide order dated 01.07.2025 passed in Cr. Misc. Nos. 22845 of 2025 and 31493 of 2025. Moreover, he is languishing in judicial custody since 11.08.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of six cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sonepur P.S. Case No. 217 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Saran at Chapra with a condition that the petitioner will not indulge in similar nature of offences in future.
