====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Muffasil P. S. Case No. 240/2022 in a case registered for the offence under Sections 341, 323, 379, 327, 436, 427, 504/34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of occurrence, while the informant was constructing his house, in the meantime, all the accused persons including this petitioner and 15-20 unknown persons came there and objected construction of the house. Thereafter, all the accused persons forcibly demolished the boundary walls. Petitioner is alleged to have set the house of informant on fire and assaulted father of

Patna High Court CR. MISC. No.69496 of 2024(2) dt.19-12-2024 2/2 informant. It is further alleged that all the accused persons entered the house of informant and looted cash amounting to Rs. 2 lacs.

4. Learned counsel for the petitioner submits that there is pre-existing land dispute between the parties due to which scuffle took place in which both sides sustained injuries. Case and counter case. Petitioner is in custody since 23.07.2024 Chargesheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of dispute and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Muffasil P. S. Case No. 240/2022.
