2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 253 of 2023 registered for the offence under Sections 399, 402 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act.

4. As per the prosecution case, the petitioner along with others criminals was caught planning loot.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case.

6. Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.67078 of 2023(2) dt.17-10-2023 2/2 bail of the petitioner by contending that the weapons has been recovered from the gang and one cartridge was recovered from the petitioner and the petitioner has antecedents and he is accused of committing a dacoiti earlier.

7. In view of the facts and circumstances, as mentioned above, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, the prayer of bail of the petitioner is rejected herewith.
