JUSTICE ARUN KUMAR ORAL ORDER 10-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 17.7.2017, seeks bail in Janta Bazar PS Case No. 27 of 2017 registered under Sections 304B/34 of the IPC.
The allegation in brief is that within three months of the marriage petitioner's wife died unnatural death by consuming poison, allegation is that she was tortured for realizing further demand of dowry and the petitioner is the husband. Learned Counsel for the petitioner submits that no external injury was found in the post mortem report.
Whereas learned Counsel appearing on behalf of the State submits that froth was coming out from the mouth of the deceased and viscera report indicates that she died of poisoning. Having considered the fact that only within three months of the marriage deceased died unnatural death coupled with demand of dowry and torture for realizing dowry, the court is not persuaded to grant bail to the petitioner.
The prayer for bail stands rejected.
The trial court is directed to expedite the trial and preferably conclude the same within a period of one year after framing of the charge and if the trial does not conclude within the said period the petitioner may renew the prayer for bail.
