The petitioner seeks bail in a case instituted for the offences under Section 363(A) of the Indian Penal Code. The prosecution case in short is that daughter of the informant was kidnapped with ill intention.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim has already been recovered. On recovery, the statement of the victim has been recorded under Section 164 Cr.P.C. in which she has stated that she had left the house out of her own sweet will. There is no allegation of any physical or sexual assault alleged against the

On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -1st Nawada in connection with Akbarpur P.S. Case No. 244/2019.
