The petitioner is in custody since 23.07.2019 in connection with Chapra Rail P.S. Case No. 112/2019 registered for the offence punishable under Sections 401/414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recoveries were from co-accused Dhiraj Kumar and not the present petitioner and there is only a recovery of the mobile phone which belongs to the petitioner and is not a stolen property. It is further submitted that save and except one other case, for which the petitioner has filed a supplementary affidavit, the petitioner has no other criminal antecedent.
