Petitioner, already in custody since 04.07.2016, seeks bail in connection with Chandan P.S. Case No.87 of 2015, registered under Sections 406, 409, 420 and 34 of the Indian Penal Code.

Allegation in brief is that for the financial year 201112 and 2012-13, the petitioner, Executive Member of the PACS along with the Chairman of the concerned PACS embezzled Rs.5 lacs as after withdrawing the said amount, no paddy was supplied to S.F.C.

Patna High Court Cr.Misc. No.19320 of 2018(3) dt.09-05-2018 2/2 Earlier the petitioner had moved for regular bail but the same was rejected vide order dated 01.03.2017, passed in Cr. Misc. No.43617 of 2016 with a direction to the trial court to conclude the trial within a year and the report of the trial court reflects that after framing of the charge, the prosecution witnesses have turned up.

Having considered the period of custody, petitioner Manju Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Chandan P.S.
