JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420,467,468,471/120B of the Indian Penal Code.

Prosecution case is that this petitioner in collusion with other accused persons got appointed teachers on the basis of forged and fabricated educational certificates. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Decision of appointing teachers was collective decision of the selection committee and the same was not taken by the petitioner individually who was Mukhia at the relevant time. There is no source to verify the authenticity of the education

Learned counsel for the Vigilance opposes the prayer for bail.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghatti, Gaya in Amas Police Station Case No. 282 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
