2. The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 366(A) of the Indian Penal Code.
3. As per allegation in the FIR, minor daughter of the informant, aged about 13 years went for tution class but did not return. During search, it came to light that petitioner has abducted her minor daughter.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. In statement u/s 161 Cr.P.C. she has stated that petitioner is known to her and there is love affair between both of them and in statement recorded u/s 164 Cr.P.C.
Patna High Court CR. MISC. No.66698 of 2023(4) dt.06-02-2024 2/2 she has not raised her finger against the petitioner for any physical misbehave or any overt act. Petitioner has got no criminal antecedent and languishing in judicial custody since 19.3.2023.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 95 of 2023.
