JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 30-08-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 11.10.2017 passed by learned 2nd Additional District and Sessions Judge, Naugachia in Sessions Trial No. 84 of 2017 arising out of Parbatta P.S Case No. 59 of 2015 registered under Sections 302 and 120 B of Indian Penal Code and 27 of Arms Act whereby the application of the petitioner under 227 of the Code of Criminal Procedure has been rejected. Mr. Brajesh Kumar Singh, learned counsel for the petitioner submitted that since his client has already taken away his file from him and he has already granted no objection certificate, he has no instruction to appear in the matter. Neither the petitioner nor any other counsel is present before the Court.
