JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Madanpur P.S. Case No 151 of 2015 registered for offences alleged under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that this petitioner has been implicated in the present case on the basis of confessional statement of Pintu Paswan. The said Pintu Paswan has already been granted regular bail vide Criminal Miscellaneous No. 37261 of 2016. The petitioner is in custody since 17.02.2016. He further submits that the petitioner has got one case on his head, in which he is on bail. However, statement to this effect has not

Patna High Court Cr.Misc. No.1 of 2018 (2) dt.11-01-2018 2/2 been mentioned in paragraph-3 of the petition. Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No 151 of 2015 subject to the conditions U/S 437(3) Cr.P.C and on satisfying the court below that he is on bail in Buniyadganj P.S. Case No. 28 of 0216, stated in paragraph-3 of the petition.
