Petitioners apprehend their arrest in Patrakar Nagar P.S. case no. 583 of 2017, instituted for the offence under Section(s) 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioners has submitted that these petitioners are father and mother of the boy with whom it is alleged that marriage of the daughter of the informant was settled. Ring ceremony was also performed but, latter on, accused persons started demanding Rs. 30,00,000/- (thirty lacs) as dowry.
In the written report itself it is mentioned that informant learnt that marriage of the son of the petitioner was settled
Patna High Court Cr.Misc. No.2940 of 2018(2) dt.16-02-2018 2/3 elsewhere on 26.11.2017 and thereafter the instant case has been filed after delay of 75 days from the alleged date of demand of money by the petitioners for performing the marriage of their son with the daughter of the informant. Learned counsel for the petitioner has submitted that one of the accused, namely, Mritunjay Kumar has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 01.02.2018 passed in Cr. Misc. no. 4413 of 2018. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Patrakar Nagar P.S. case no.
583 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge-10-cum- ACJM, Patna, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Patna High Court Cr.Misc. No.2940 of 2018(2) dt.16-02-2018 3/3 reason will automatically cancel bail bond of the petitioners and
(3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
