The petitioner is in custody since 09.06.2019 in connection with Sugauli P.S. Case No.214 of 2019 registered for the offence under Sections 341, 323, 302, 504/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present petitioner is alleged to have attacked the husband of the informant with brick. It is further submitted that Sarswati Devi and Aarti Devi have attacked the husband of the informant on his head and neck resulting in his death. Learned counsel further submitted that co-accused Sarswati Devi has been granted the privilege of anticipatory bail in Cr.Misc.
Patna High Court CR. MISC. No.60387 of 2019(2) dt.25-10-2019 2/2 No.60684 of 2019, vide order dated 21.10.2019. Learned counsel for the informant, however, stiffly resists the present bail application and submits that the postmortem report indicates that the death had occurred by hard and blunt substance.
Having considered the aforementioned facts and circumstances and that the similarly situated co-accused has been granted the privilege of anticipatory bail, let the petitioner, above named, be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, in connection with Sugauli P.S. Case No.214 of 2019.
