This is a case registered under Sections 147, 148, 149, 448, 341, 323, 307, 504 and 379 of the Indian Penal Code later on Section 302 of the I.P.C has been added.

It is submitted by the learned counsel for the petitioner that the allegation of assault attributed to the petitioner is with reference to the informant and the injury report reveals that the informant has sustained simple injury. He submits that there is subsisting land dispute between the informant and the petitioner and that there is case and counter case. The petitioner having no criminal antecedent has falsely been implicated in this case and he is in jail custody since 06.02.2018.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 3rd, Nalanda at Bihar Sharif in Manpur P.S. Case No. 80 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
