The petitioner seeks regular bail in connection with Ghoghardiha P.S. Case No. 99 of 2016, registered for the offence punishable under Section 392 of the Indian Penal Code.
The case of the prosecution is that while the informant was going to Hatani from Ghoghardiha on his motorcycle and had reached near Ekata Chowk, the accused persons had intercepted the petitioner and had then snatched the key of the motorcycle from the informant and had taken away the motorcycle alongwith them.
The learned counsel for the petitioner submits that the petitioner is innocent and is languishing in custody since

I have perused the case diary and find that the complicity of the petitioner is writ large in the present case and he has been implicated in a heinous crime of stealing the motorcycle. The petitioner is also having a very bad criminal antecedent inasmuch as he is an accused in seven other cases of similar nature.
In such view of the matter, I find that it would not be in the interest of society to release the petitioner, who is a habitual offender, hence, the prayer for grant of regular bail is rejected.
