Petitioner seeks bail in Kargahar P.S. Case No.167 of 2017 instituted for the offence under Section(s) 328, 304(B)/34 Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act pending in the Court of Additional Chief Judicial Magistrate, Sasaram.

Petitioner is husband of the deceased. There is allegation against this petitioner that for non-fulfillment of demand of dowry he along with other accused persons committed murder of the deceased by administering poison. Case diary has been received. It is mentioned in post mortem report that several viscera have been preserved. Viscera

Patna High Court Cr.Misc. No.19090 of 2018 (5) dt.04-10-2018 2/2 report has been received, wherein, doctor has found poisonous substance as mentioned at serial nos.1 to 5.

In such circumstances, this Court is not inclined to enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected. The Trial Court is directed to expedite the trial. Liberty is given to the petitioner to renew the prayer for bail after nine months, if no substantial progress is made in trial. (Sanjay Priya, J) JA/- Rohit Kr.
