2. The petitioner seeks bail in connection with Kadwa P.S. Case No. 66 of 2025 registered for the offence under Sections 126(2), 115(2), 118(1), 118(2), 3(5) of BNS.

3. The petitioner is named in the F.I.R. and is in custody since 03.05.2025.

4. As per FIR, during occurrence the acid was thrown upon informant by one Noor Sama, where other accused persons including petitioner was also alleged to be involved in this occurrence.

5. Learned counsel appearing on behalf of the petitioner submitted that as per FIR, the allegation regarding throwing of acid is specifically available against co-accused Noor Sama and this petitioner appears implicated only being a family

While concluding the argument, it is submitted that petitioner is found involved in two more criminal cases where he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as allegation of throwing acid is not available against this petitioner rather same is against co-accused Noor Sama, coupled with fact that investigation of this case is already completed, where petitioner remains in custody since 03.05.2025, accordingly petitioner above named, is directed to be released on bail in connection with Kadwa P.S. Case No. 66 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
