The petitioners apprehend their arrest in connection with Majhaulia P.S. Case No. 248 of 2019, registered under Section 366(A)/34 of the Indian Penal Code and Section 8 of the POCSO Act.

The accusation is of kidnapping of daughter of the informant by Sagar Kumar and six others named in the F.I.R. including the petitioners.

Learned counsel for the petitioners submits that, in fact, daughter of the informant left her parental house and performed the marriage in temple with co-accused, Sagar

Patna High Court CR. MISC. No.64117 of 2019(2) dt.21-10-2019 2/2 Kumar, according to her own sweet will. After realizing the real fact, informant Mukesh Mahto and his daughter filed an application in this regard in the Court of Additional Sessions Judge-I-cum-Special Judge (SC/ST/POCSO), Bettiah, West Champaran on 23.07.2019. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of their weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge (SC/ST/POCSO), Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 248 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
