The petitioner seeks regular bail in connection with Majhaulia P.S. Case No. 235 of 2016, for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code. The allegation is regarding the accused persons having killed the deceased lady, who happens to be the wife of the petitioner herein.

The learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner herein and in fact a compromise has been effected into between the petitioner and the informant as is apparent from Annexure-2 annexed to the petition which has also been filed before the learned Trial Court. Admittedly, the victim lady was suffering

Patna High Court Cr.Misc. No.21300 of 2018 (3) dt.17-05-2018 2/2 from mental problem. It is further submitted that the petitioner is languishing in jail since 15.12.2017 and is having a clean antecedent.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Majhaulia P.S. Case No. 235 of 2016.

It is further directed that the petitioner would mark his presence before the Officer Incharge of the concerned Police Station at 10 A.M. on each and every Monday of the month and in the event of his failure on two consecutive occasions to mark his attendance, the present privilege of bail shall stand cancelled automatically.
