2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 338, 336(3), 340(2), 331(4), 303(2), 317(5), 310(4)(5) and 3(5) of the B.N.S.S. (Sections 467, 468, 471, 457, 379, 414, 399 and 402/34 of the Indian Penal Code) and under Sections 25(1-b), 26 and 35 of the Arms Act.

3. The case of the prosecution is that from possession of this petitioner one loaded country made pistol and two live cartridges were recovered.

4. Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner rather he has been framed in this case due to his

Patna High Court CR. MISC. No.67318 of 2025(2) dt.17-09-2025 2/2 criminal antecedents. Learned counsel for the petitioner has further submitted that the petitioner is in judicial custody since 25.01.2025.

5. Learned APP for the State has vehemently opposed the application for bail and has submitted that the petitioner is having criminal antecedent of five cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sessions Trial No. 167 of 2025, CIS No. 167 of 2025 arising out of Sadar P.S. Case No. 44 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-VIII, Purnea.
