The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 27 of 2016, registered for the offence punishable under Section 394 of the Indian Penal Code. The allegation is regarding the accused persons having apprehended the motorcycle of the informant and thereafter, they had committed loot. As far as the petitioner is concerned, one laptop of the informant is said to have been recovered from his possession.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the fact is that he has purchased the said laptop from someone else

Patna High Court Cr.Misc. No.23350 of 2018(4) dt.02-07-2018 2/2 and it turned out to be a stolen laptop. It is further submitted that nonetheless, the fact is that no T.I.P has taken place, the petitioner is languishing in custody since 19.01.2018 and therefore, the complicity of the petitioner in the alleged occurrence has not been established.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S.
