17-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Hajipur Town P.S. Case No. 396/2017 registered for the offence punishable under Sections 420, 467, 468, 471, 384, 120(B)/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected with observation that the court was not inclined to grant bail to the petitioner 'at this stage' and petitioner had liberty to renew the prayer for bail after framing of charge. Learned senior counsel for the petitioner submits with reference to Annexure-3 to the present application that the charge has already been framed. He would further submit that the petitioner is ready to abide by

Patna High Court Cr.Misc. No.3202 of 2018 (2) dt.17-01-2018 the terms and conditions which may be imposed by this Court for the grant of bail.

On the other hand, learned Additional Public Prosecutor representing the State opposes the prayer for bail. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - II, Hajipur (Vaishali), in connection with Hajipur Town P.S. Case No. 396/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure and further condition that he will fully cooperate in course of trial and shall put his appearance in the trial court as and when required. Two consecutive failures in putting appearance without any plausible reason in course of trial would invite cancellation of bail of the petitioner.

This application stands disposed off.
