JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Shastri Nagar P.S.Case No. 572 of 2017 registered under Sections 365, 376, 509 and 511 of the Indian penal Code and Section 67 of I.T.Act.

Allegation in brief is that petitioner used to make sexual relationship with the prosecutrix for last four-five months and one day he started dragging to take her away for solemnization of marriage with her.

Submission is that both were living in the same rented premises and as per allegation itself there was consensual physical relationship between two and the lady is 40 years old whereas petitioner is 22 years boy and the police has submitted charge

Having considered the aforesaid facts and circumstances, the petitioner, namely, Chandan Singh @ Chandan Kumar is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Judge-IV -cum-ACJM, Patna in connection with Shastri Nagar P.S. Case No. 572 of 2017. (Arun Kumar, J) Sujit/- U T
