2. The petitioner is apprehending his arrest in connection with Buniyadganj P.S. Case No. 199 of 2023 registered for the offence punishable under Section 379 of the Indian Penal Code, Section 15 of the Environment Protection Act and Sections, 4, 21 and 22n of the Mines Mineral (D$R) Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.66589 of 2023(3) dt.22-01-2024 2/2 learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
