JUSTICE ARUN KUMAR ORAL ORDER 17-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 28.2.2017, seeks bail in Ramnagar PS Case No. 179 of 1998 registered under Sections 364A of the IPC.

The petitioner is a non FIR accused under Section 364A IPC vide Ramnagar PS Case No. 179 of 1998; charge-sheet was submitted against him as absconder, he has remained absconder for approximately 18 years and has also criminal antecedent of three cases under Section 364A IPC and he was remanded in the present case in the recent past.

Having considered the said facts and circumstances, presently the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of one and half year and if the trial does not conclude within the said period the petitioner may renew his prayer for bail.
