2. The petitioner has preferred this application for grant of regular bail in connection with Banka P.S. Case No. 177 of 2025 dated 17.04.2025 registered for the offences punishable under Sections 303(2) of the B.N.S.
3. As per the prosecution case, the informant purchased an old Scorpio vehicle from one Santosh Kumar at the cost of Rs. 12 lakhs and some amount of money was still due, so one key of the vehicle was with the owner Santosh Kumar. Later on, the vehicle was parked in the garage of the informant's building. On 15.04.2025, the informant alleged that the lock of garage was broken and the said Scorpio vehicle was

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in this case on mere suspicion. It is further submitted that the petitioner and co-accused person were found sitting inside the said vehicle and he has no knowledge that the said vehicle was stolen one and from the said vehicle total 120 litres of illicit foreign liquor, mobile phone, one country-made katta, two live cartridges were recovered. The petitioner has no concern with the alleged occurrence. The petitioner has two criminal antecedents in which he is on bail in both cases as stated in para 3 of the bail petition. The petitioner is in custody since 29.07.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Banka P.S. Case No. 177
Patna High Court CR. MISC. No.64293 of 2025(2) dt.17-09-2025 3/3 of 2025, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
