2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

3. The petitioners are apprehending their arrest in connection with Gopalpur P.S Case No. 267 of 2023 dated 03.05.2023 registered for the offence punishable u/ss 341, 323, 307, 504 read with 34of the Indian Penal Code and 27 of the Arms Act.

4. As per the prosecution case, when the informant Dipu Kumar was returning to home after duty then the petitioners and the accused persons are alleged to have abused and assaulted him with belt. It is further alleged that the co-accused Kisan Kumar fired on him in which one bullet hit him at left side of his chest.

5. Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. It is further submitted that there is no specific allegations against the petitioners rather than general and omnibus in nature. Learned counsel has further submitted that there is land dispute between the parties. The petitioner nos. 1 and 2 have no criminal antecedent whereas the petitioner no.3 has one criminal antecedent as stated in para 3 of the bail petition.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on

No.74669 of 2023(2) dt.06-12-2023 3/3 furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Patna in connection with Gopalpur P.S. Case No. 267 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
