JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-10-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 109, 61(2), 351(2), 3(5), 118(2), 326(g), 324(4) and 325(5) of the Bhartiya Nyaya Sanhita.

3. On the instigation of other co-accused persons, it is alleged that these two petitioners alongwith others set the hut of informant on fire, as a result of which, two persons namely Birendra Singh and Prem Chandra Kumar, who were sleeping inside the hut, sustained burn injury.

4. Learned counsel for the petitioners submits that petitioner no. 1 is own sister of informant and petitioner no. 2 is cousin brother of husband of petitioner no. 1. As a matter of

No.68839 of 2025(2) dt.07-10-2025 2/2 fact, a title suit, vide Title Suit No. 538 of 2023, is pending between petitioner no. 1 and informant in the Court of learned Sub-Judge, Bikramganj, Rohtas. He further submits that due to admitted land dispute between the parties, this false and concocted case has been lodged. Injuries sustained by the injured persons are simple in nature. 5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Nasariganj P.S. Case No. 424 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
