The petitioner seeks bail in connection with Ramnagar P.S. Case No. 480 of 2017 for the offences punishable under Sections 353, 341, 323, 307, 414, 332 and 333 of the Indian Penal Code, Section 27 of the Arms Act and Sections 33, 41 and 42 of the Indian Forest Act.
The allegation is regarding the police having got information that the accused persons are planning to commit dacoity and when the police is said to have arrived at the place of occurrence, the accused persons started fleeing away on a tractor and in the process one of the accused person fell down and was arrested by the police, who then disclosed the name of the present petitioner and three
Patna High Court Cr.Misc. No.24855 of 2018 (3) dt.04-07-2018 2/2 others as his accomplice. The petitioner was arrested subsequently by the Police.
The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and he has been falsely implicated in the present case and is languishing in custody since 24.1.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ramnagar P.S.
