The petitioner seeks regular bail in connection with Char Pokhari P.S. Case No. 173 of 2017 for the offences punishable under Sections 392, 395 and 412 of the Indian Penal Code.
The allegation is regarding unknown persons having committed loot by intercepting the Sales Executive of Ganpati Traders and having snatched a sum of Rs.40,000-50,000/-, mobile etc.
The learned counsel for the petitioner submits that as far as the petitioner is concerned, his name has transpired upon the confessional statement made by the co-accused person namely Raju Paswan. It is submitted that the said co-accused person Raju
Patna High Court Cr.Misc. No.24036 of 2018 (3) dt.03-07-2018 2/2 Paswan has already been granted bail by this Court vide order dated 23.05.2018 passed in Cr. Misc. No. 24248 of 2018. It is further submitted that the other accused persons have already been granted bail by this Court. The petitioner is stated to be having a fair antecedent barring one case. It is further submitted that the petitioner is in custody since 22.02.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Char Pokhari P.S. Case No. 173 of 2017.
