2. The petitioner is in custody since 14.12.2022 in connection with Sasaram Town P.S. Case No. 1008 of 2021 registered for the offence punishable under Sections 364 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are said to have kidnapped the victim. However, the victim has been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel for the petitioner further submits that petitioner is not named by the informant. He submits that the petitioner has not been put on T.I. Parade. Learned counsel for the petitioner further submits that the name of the petitioner surfaced in the

Patna High Court CR. MISC. No.66691 of 2023(2) dt.16-10-2023 2/2 confessional statement of the co-accused Vivek Kumar which has no evidentiary value.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM (I/c), Sasaram in connection with Sasaram Town P.S. Case No. 1008 of 2021.

7. The petitioner is directed to co-operate in the trial and he will also mark his attendance in Darigaon police station on every Sunday of the month.
