====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by learned counsel of the informant.
Petitioner seeks bail in a case registered for the offence punishable under Section 366(A), 34 of the Indian Penal Code.
The statement of victim has been recorded under Section 164 of the CrPC, in which she, specifically, stated that she was forcibly taken by the petitioner on 09.04.2019 at about 6.00 a.m. and subsequently, on the same day, at about 12.00 noon, she was dropped on the same place from where she was kidnapped and thereafter, her father came there and took her to her home.

No.67486 of 2019(2) dt.04-11-2019 2/2 Submission on behalf of the petitioner is that according to the prosecution case itself, the alleged occurrence took place in the morning of 09.04.2019 and the victim returned to her home on the same day and the informant lodged the present case on 12.04.2019 but it is surprising enough that in the aforesaid written report, the informant claims that his daughter was still missing.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Kaimur at Bhabua in connection with Kudra P. S. Case No. 124 of 2019.
